An article featured in the Wire : https://thewire.in/rights/children-women-prisoners-india

Check out this article, On legal aid in India, and guess what, this is as old as 2018, But word to word still stands true to this date....

Published on March 21, 2023 by Seeds of Change

Nothing has really changed since this article was published in National Herald, 2018. Things have just gotten worse, with more number of women from economically background poor families, rotting in the jails, with no ray of hope.......

About

LIBERATION & REHABILITATION PROGRAM OF DEPRIVED WOMEN & CHILDREN IN PRISONS

OBJECTIVE:
  • This open collective aims to help women and young children held-up in prisons, helpless and with no money to bail them out.
MISSION:

Our mission is twofold:
  1. To LIBERATE at least 1,000 women and children from their imprisonment.
  2. And to provide REHABILITATION with the resources and tools needed to rebuild their lives and secure a better future.
We believe that every person deserves the chance to live with dignity and respect and that by supporting these individuals, we can make a real difference in their lives and in our communities.

 BACKGROUND:

A countless number of women along with young kids are held up in prisons in India, for minor nuisance or petty thefts.  These women along with their young kids are suffering in the jails away from their families.  They do not have enough money and do not have enough education to handle the legal-Know-Hows.   They are stuck in these prisons for more than 3-6 months, despite getting automatic bail, but unable to pay these petty legal fees/fines of just a mere - USD 200 - USD 250 !!

WHAT KIND OF CRIMES ARE THEY HELD FOR:

Close to 60% are just held on petty crimes like begging on streets, and neighbors raising false cases or pick-pocketing.  Most of them are first-time convicts, and due to a lack of knowledge, they are stuck in such situations unfortunately, and the mental impact on the children is beyond explainable.

 CURRENT SCENARIO:
  • These women, along with young kids (Some of them being just babies 3-6 months old), are put in jails on various petty cases.
  • As per the laws prevailing in India, Mandatory Bail is automatically given to them with fines amounting to around USD 200 – USD 250.
  • Their families are below the working class, and these fines are too high for them.
  • And hence such women and children are left unattended, unclaimed, and behind bars for months together, waiting desperately for a ray of hope.

WHOM DO WE WANT TO ADDRESS:

We want to free 1000 women and children (across India in Phase 1 Implementation) who were:
  1. Booked on false charges by their neighbors/employers/others,
  2. Booked on petty nuisances,
  3. Booked for begging in the streets,
  4. First Convicts, booked on petty crimes like pick-pocketing, but who are desirous to sincerely transform their lives.

HOW WILL WE ADDRESS THEIR FREEDOM FROM PRISON
  1. Work with the State Governments/Jail Superintendents/Concerned Authorities in identifying the women/Kids that need immediate help and rehabilitation.
  2. Pick all cases that already have completed mandatory terms, and for which already bail is issued, but unable to pay fines.
  3.  Complete the legal paperwork, pay respective fines/bail amounts, and prepare for their release.
  4. Inform their families and ensure complete coordination is done appropriately.
  5. Schedule and execute their releases.
  6. Ensure they are safely reunited with their families.

HOW WILL WE ADDRESS THEIR REHABILITATION
  1. Provide clothing & food to meet their immediate needs.
  2. Admitting the Concerned Women & Children, and Orphans & Minors into the Government Rehabilitation Centers and Social Welfare Homes, in conjunction with the respective Government Departments and in direct coordination with the concerned authorities.
  3. Providing Self-Employment programs along with full support and guidance to those who want to start their earnings afresh in the right frame.
  4.  Other activities include (but are not limited to) Counseling & Therapy, Educational Programs, Job Training & Placement Programs, Mentorship Programs, etc.

 FUND REQUESTED FOR
  • USD 300,000

 APPLICATION OF FUNDS

The fund will be used for the following:
  • Payment of fines and bail amount (around USD 200 – USD 250) per head
  • Legal fees of Advocates (Attorneys/Lawyers)
  • Immediate essential financial assistance post-release
  • Rehabilitation Costs
  • Operational Costs

TARGET
  • 1000 women & kids to be freed and rehabilitated in Q2'2023.

APPEAL

We look forward to your support of this cause,
for there is no bigger charity, than the charity of freedom!

Please free our women and our kids...!
Please bring a ray of hope back to their lives...!
Please help them claim their basic human rights...!
Please empower them...!

We will share stories, progress, images, videos, and photos as we progress and keep creating impact...

 THANK YOU SO MUCH!

 DISCLAIMER

Nowhere did we blame or intend to blame either Government of India or the Concerned Authorities for the imprisonment of the said Women. It is heartening that the law of the land (India) is automatically giving mandatory bail to such persons. We just want to highlight the plight of financial helplessness even to make use of such granted bail. Our intention/aim/goal is to release such women and provide them with rehabilitation programs with the help of the Government of India and the respective authorities in India.
